Terms of Service

1. Who we are. This website and the products sold on it are provided by Brighter Smiles ("we", "us"), an online store based in Ireland. Contact: info@brightersmilesstore.com.

2. These terms. These terms apply to every order placed on brightersmilesstore.com. Please read them with our Returns & Right of Withdrawal policy, Shipping Policy, Subscription & Cancellation Policy and Privacy Policy, which form part of these terms. Nothing in these terms affects your statutory rights as a consumer.

3. Products. We describe and show our products as accurately as we can. Product packaging may vary slightly from the photos. Use products only as directed on the pack. Do not use whitening products if you are under 18, pregnant or breastfeeding, or have untreated dental problems. Ask your dentist if you are unsure.

4. Prices and payment. Prices are in euro (or your local currency where shown) and include VAT. Delivery charges are shown before you pay. We take payment when you place your order. If a price is clearly wrong because of an error, we will contact you before dispatch and you may cancel for a full refund.

5. Your order and our contract. Your order is an offer to buy. The contract is formed when we email you an order confirmation. If we cannot supply an item, we will tell you and refund you in full within 14 days.

6. Pre-orders. Where a product is on pre-order, the expected dispatch date is shown on the product page. You can cancel a pre-order for a full refund at any time before it is dispatched.

7. Delivery. Delivery times and costs are set out in our Shipping Policy. Risk in the goods passes to you when they are delivered.

8. Subscriptions. If you choose a subscription, you authorise us to charge your payment method at the price and frequency shown on the product page and at checkout until you cancel. You can cancel at any time before your next billing date from your account or by emailing us. See our Subscription & Cancellation Policy.

9. Withdrawal and returns. You have a 14-day right to withdraw as set out in our Returns & Right of Withdrawal policy. Use the Withdraw from contract button in our website footer or email us.

10. Faulty goods. If a product is faulty or not as described, you are entitled to a repair, replacement or refund under Irish consumer law.

11. Our liability. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.

12. Reviews and content. Any review you submit must be your own honest opinion of a product you bought. We do not edit reviews, and we do not remove reviews because they are negative.

13. Personal data. We use your personal data as described in our Privacy Policy.

14. Complaints. Email info@brightersmilesstore.com. We reply within 1 business day and aim to resolve complaints within 14 days. You can also contact the Competition and Consumer Protection Commission (ccpc.ie).

15. Governing law. These terms are governed by Irish law. If you live elsewhere in the EU, you also keep the protection of the mandatory consumer laws of your country, and you may bring a claim in the courts of your country.

16. Changes. We may update these terms. The version in force when you place your order applies to that order.
